Can a potential employer ask to do a background check prior to offering you a job?

JB asked:

I’m in California if that makes any difference. I had an initial interview with a Kaiser recruiter and she did not offer me a position but said that she would send my information on to the manager. In the mean time she sent benefit information, background check authorization, and a drug test authorization.
Thank you.

Depends on the job, although every employer can do a limited police background check on you with your permission

  2. Michelle Says:

yes they can. Most jobs do those now. They don’t want to hire ex-felons or child predators.

  3. Flower Child Says:

Yes, they can, in FL anyway.

  4. Inzend L Says:

    yes for sure

  5. Kier22_2 Says:

    Absolutely.
I am going thru a very intensive backgroud check & will not get offered the job if it doesn’t go thru. But I have not officially been offered the job.

  6. Curious Says:

Yes - that’s legit. You should ask if those tests are a pre-qualification for getting offered the job - it may be a condition of employment depending on the job. Call to clarify if you do the tests before or after the job offer.

  7. AirsoftMan425 Says:

Yes, it’s completely legal. If someone finds out that you are a felon or use drugs, they have a right not to employ you. Some states are offering a bonus to employers that hire ex-felons, so it will make a difference for some people.

  8. Laughing Libra Says:

Yes. School districts usually wait until the FBI fingerprinting investigation is cleared.

Defense companies may require it because of the sensitivity.

Hopefully, law enforcement agencies do it.

  9. Ian C Says:

I live in NJ, so I couldn’t say about CA, but here they can.

  10. misz b0s$ Says:

well yes they can i think it’s more logical to do it before offering you the job so they dont have any problems after they’ve already hired you.

  11. spawnofazazel Says:

Most places ask you to sign a consent form for a background check and drug test, and hire based on the results.

  12. Brunette10 Says:

YES they can ask for background checks - as well as credit checks and a drug test.

  13. Gus The Bus Says:

I think all states and all jobs do that before hiring someone, They want to prevent from hiring serial killers, psychos or anyone who can put their other workers in danger. Not that you will but that’s what employers do.

  14. sizzlinghot Says:

You absolutely do not have to agree to a background check until you’ve interviewed for the job. This person is trying to keep herself busy, at your expense.

Agree to a background check when the EMPLOYER has agreed that you are a viable candidate.

If you allow the recruiter to do it, you are compromising your privacy and civil rights.

Here’s what you should say. This recruiter is not hiring you and is not going to pay your salary. Tell the recruiter to do her job and get you set up with an interview.

Then the EMPLOYER can do a background check.

To do one they need your SOCIAL SECURITY NUMBER. Do you want to give that to some idiot who is not going to pay you a salary?

  15. Kristine S Says:

yes he can its legell. just make sure you ask about it all if he starts wanting strange things. they can check if you use drugs and if you have anything on your poliece records.

  16. Vote democrat, Hamas will! Says:

yes they can, and if you want to be offered a job with this company you must pass the back round check & drug screen.
after passing you may be offered a job, but it’s not unreasonable for them to ask that of you prior to employment.

  17. nickipettis Says:

the fed govt can absolutely do a background check before offering you a job.

It sounds like they want to hire you if you pass the background check.

  18. Heather V Says:

Yes, most jobs do this now. They will not waste their time offering you a job unless they know they actually want you there.

  19. dinodino Says:

Yes, but they probably won’t. It costs too much money for them to do it for everyone they interview for a job. They might do it after they narrow their search. I never did a background check until we made an offer. — which was contingent on a background check.

You are not a serious candidate for any job unless you get an interview with the hiring manager

PS The recruiter just sent that stuff so you have it in case they actually want to hire you. You don’t fill it out or send it in now.

  20. loudog Says:

Yes, so they can discriminate against you if your an ex-con. They want ex-cons to keep RAPING YOUR KIDS, MURDING YOUR FAMILY AND SELLING DRUGS TO YOUR KIDS, instead of holding down a decent job and taking the 2nd chance 95% of all convicted felons will get and become a good tax paying citizen in our society. I guess I would also want them dangerious criminals to go out and **** my daughter or kill your mother or hook your kids on drugs or join a gang and do drive bys in your city and hopefully shoot one of your family, rather than them PYSCO’S trying to earn a righteous living, paying for their kids and thier responsibilities and working next to us great Americans. Get my point people your going to pay thier way one way or the other, if they can’t earn it honestly- “FOR WE ALL MAKE MISTAKES” “THROW THE 1st STONE” etc etc. They will earn it they way they just got taught in our tax funding State University Prison. So those of you out there who fall for all that properganda political figures feed you, remember this.
